1. Introduction

Chibi-03 (“App”) is operated by CyCon Technology Limited, a company registered in Hong Kong SAR (“Company”, “we”, “us”, or “our”).

By downloading or using the App, you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old, or the age of legal adulthood in your country of residence (whichever is higher), to use the App.

By using the App, you confirm that you meet this requirement.

You agree not to provide, share, or make the App available to any individual who is:

  • Under 18 years of age, or
  • Below the age of legal adulthood in their jurisdiction.

You are solely responsible for ensuring that the App is not accessed or used by underage individuals through your device or Apple ID.

3. Platform

  • The App is available exclusively on Apple iOS devices.
  • No separate account is required.
  • Access is linked to your Apple ID.

4. Subscription and Billing

4.1 Plan

  • USD $2.99 per month
  • Includes up to 100 interactions per day

4.2 Free Trial

  • A 3-day free trial may be offered.
  • After the trial ends, the subscription automatically converts to a paid plan unless canceled.

4.3 Auto-Renewal

  • The subscription automatically renews monthly.
  • Your Apple ID account will be charged within 24 hours before the end of the current period.
  • Renewal continues unless canceled at least 24 hours before the renewal date.

4.4 Management and Cancellation

  • You can manage or cancel your subscription in iOS Settings → Apple ID → Subscriptions.
  • Cancellation takes effect at the end of the current billing period.

4.5 Payments and Refunds

  • Payments are processed by Apple via In-App Purchases.
  • Refunds are handled only by Apple under Apple’s policies.

5. App Description

Chibi-03 is an AR-based AI interaction app that includes:

  • AI-generated text, voice, and animations
  • Simulated emotional responses
  • Local user-generated content, including recordings and avatar motions

6. Local Data Storage

  • The App operates without a backend server.
  • All content is stored locally on your device only.
  • We do not access, collect, or store your content remotely.

7. User Content

  • You retain full ownership of all content created in the App.
  • The Company does not store or access such content.
  • You are responsible for data backup and device security.
  • Deleting the App may result in permanent data loss.

8. Acceptable Use

You agree not to:

  • Use the App unlawfully or abusively
  • Attempt to reverse engineer, modify, exploit, or interfere with the App
  • Use the App in ways that may harm yourself or others
  • Bypass usage limits, subscription restrictions, or technical protections
  • Share the App with underage individuals or allow them access through your device or Apple ID

We may restrict or terminate access for violations.

9. AI Disclaimer

The App includes AI-generated content that may simulate human-like behavior.

You acknowledge that:

  • AI responses may be inaccurate, inconsistent, or unexpected
  • The AI is not a real person
  • The App is for entertainment purposes only

The App does not provide:

  • Medical advice
  • Mental health support
  • Professional guidance

10. AR Safety

You are responsible for using the App safely.

Do not use the App:

  • While driving
  • In hazardous environments
  • In any situation where AR use may distract you from your surroundings

We are not liable for injuries caused by misuse.

11. Limitation of Liability

To the fullest extent permitted by law:

  • The App is provided “as is” and “as available”
  • We disclaim all warranties, whether express or implied
  • We are not liable for indirect, incidental, consequential, or special damages
  • We are not liable for loss of locally stored data, device issues, or service interruptions

12. Termination

We may suspend or terminate your access to the App if:

  • You violate these Terms
  • Your use creates risk, harm, abuse, or legal exposure

You may stop using the App at any time.

13. Intellectual Property

All App-related technology, software, design, branding, and assets are owned by the Company or its licensors.

You receive a limited, non-transferable, non-exclusive, revocable license to use the App for personal, non-commercial use.

14. Changes to Terms

We may update these Terms at any time. Continued use of the App after updates are published means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of Hong Kong SAR, without regard to conflict of law principles.

16. Apple Terms

  • This agreement is between you and the Company, not Apple.
  • Apple is not responsible for the App, maintenance, support, or claims relating to the App.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms.
